California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 1 — Liens in General, Article 2 — Creation of Liens, Section 2882

No lien arises by mere operation of law until the time at which the act to be secured thereby ought to be performed.

Notes

Bars a lien from arising solely by operation of law before the time when the act secured by the lien ought to be performed. The rule fixes the earliest time for such a lien at the point when performance of the secured act is due, rather than an earlier time.
