California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 1 — Liens in General, Article 2 — Creation of Liens, Section 2884

A lien may be created by contract, to take immediate effect, as security for the performance of obligations not then in existence.

Notes

Allows a lien created by contract to take effect immediately as security for performance of obligations that do not yet exist. The provision permits the contractual lien to become effective before the secured obligations come into existence, rather than requiring the obligations to exist when the lien is created.
