California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 1 — Liens in General, Article 3 — Effect of Liens, Section 2888

Notwithstanding an agreement to the contrary, a lien, or a contract for a lien, transfers no title to the property subject to the lien.

Notes

Establishes that a lien, or a contract for a lien, transfers no title to the property subject to the lien, even if the parties agree otherwise. The lien therefore creates no title transfer in the encumbered property, and a contrary agreement does not change that statutory effect.
