California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 2 — Mortgage, Article 1 — Mortgages in General, Section 2921

A mortgage may be created upon property held adversely to the mortgagor.

Notes

Allows a mortgage to be created on property that is held adversely to the mortgagor. Adverse holding of the property does not prevent the mortgagor’s property from being mortgaged under this rule, so the mortgage may be created even while another person holds the property adversely to the mortgagor.
