California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 2 — Mortgage, Article 1 — Mortgages in General, Section 2923

The lien of a mortgage is special, unless otherwise expressly agreed, and is independent of possession.

Notes

Establishes that a mortgage lien is special unless the parties expressly agree otherwise and that the lien exists independently of possession. The mortgage lien therefore has the stated special character by default, while an express agreement may alter that character; possession is not required for the lien to exist.
