California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 2 — Mortgage, Article 1 — Mortgages in General, Section 2926
A mortgage is a lien upon everything that would pass by a grant of the property.
Notes
Defines a mortgage as a lien covering everything that would pass through a grant of the mortgaged property. The mortgage lien therefore extends to the same property interests that a grant of that property would transfer, using the scope of a grant to determine the scope of the mortgage lien.
