California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 3 — Deposit, Chapter 1 — Deposit in General, Article 1 — Nature and Creation of Deposit, Section 1818

A deposit for exchange is one in which the depositary is only bound to return a thing corresponding in kind to that which is deposited.

Notes

Defines a “deposit for exchange” as a deposit in which the depositary is required to return a thing corresponding in kind to the thing deposited, rather than the identical deposited item. Establishes that obligation to return an equivalent thing of the same kind as the defining feature of an exchange deposit.
