California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 4 — Loan, Chapter 3 — Loan of Money, Section 1916.11

Notwithstanding any other remedy a borrower may have based on an alleged failure to comply with Sections 1916.5 through 1916.9, the lien of the mortgage or deed of trust shall be valid.

Notes

Establishes that a mortgage or deed-of-trust lien remains valid despite any other remedy a borrower may have for an alleged failure to comply with the referenced variable- or renegotiable-rate mortgage provisions. The provision preserves lien validity while recognizing that the borrower may have another remedy based on the alleged noncompliance.
