California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 4 — Loan, Chapter 5 — Shared Appreciation Loans, Article 6 — General Provisions, Section 1917.161

Any waiver of any right of a borrower under the provisions of this chapter shall be void and unenforceable.

Notes

Bars any waiver of a borrower’s rights under the chapter by declaring the waiver void and unenforceable. The provision prevents borrower rights created by the chapter from being surrendered by agreement, because any attempted waiver of those rights has no enforceable legal effect against the borrower.
