California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 7 — Carriage, Chapter 3 — Carriage of Property, Article 4 — Freightage, Section 2138

The consignee of freight is liable for the freightage, if he accepts the freight with notice of the intention of the consignor that he should pay it.

Notes

Requires a consignee who accepts freight to pay the freightage when the consignee accepts with notice that the consignor intended the consignee to pay it. Makes liability depend on both acceptance of the freight and notice of the consignor's payment intention, tying the consignee's obligation to those stated conditions.
