California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 9 — Agency, Chapter 1 — Agency in General, Article 1 — Definition of Agency, Section 2300
An agency is ostensible when the principal intentionally, or by want of ordinary care, causes a third person to believe another to be his agent who is not really employed by him.
Notes
Defines an ostensible agency as arising when a principal intentionally, or through lack of ordinary care, causes a third person to believe that someone not actually employed by the principal is the principal's agent. Makes the principal's conduct or lack of ordinary care creating that third-party belief the defining condition.
