California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 1 — Relief, Title 2 — Compensatory Relief, Chapter 2 — Measure of Damages, Article 4 — General Provisions, Section 3359

Damages must, in all cases, be reasonable, and where an obligation of any kind appears to create a right to unconscionable and grossly oppressive damages, contrary to substantial justice, no more than reasonable damages can be recovered.

Notes

Limits recoverable damages to amounts that are reasonable in all cases. When an obligation appears to create a right to damages that are unconscionable, grossly oppressive, and contrary to substantial justice, bars recovery beyond reasonable damages, so the amount recoverable cannot exceed what is reasonable despite the obligation’s apparent terms.
