California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 1 — Relief, Title 3 — Specific and Preventive Relief, Chapter 2 — Specific Relief, Article 6 — Cancellation of Instruments, Section 3414

Where an instrument is evidence of different rights or obligations, it may be canceled in part, and allowed to stand for the residue.

Notes

Allows an instrument that evidences different rights or obligations to be canceled as to part while remaining effective as to the rest. The authority for partial cancellation depends on the instrument covering different rights or obligations and preserves the residue rather than requiring cancellation of the entire instrument.
