California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 2 — Special Relations of Debtor and Creditor, Title 1 — General Principles, Section 3429

A debtor, within the meaning of this Title, is one who, by reason of an existing obligation, is or may become liable to pay money to another, whether such liability is certain or contingent.

Notes

Defines debtor, for purposes of the title, as a person who, because of an existing obligation, is or may become liable to pay money to another. The definition includes both certain and contingent liability, so present certainty that payment will ultimately be required is not necessary for debtor status under the title.
