California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 3 — Nuisance, Title 1 — General Principles, Section 3484

The abatement of a nuisance does not prejudice the right of any person to recover damages for its past existence.

Notes

Establishes that abating a nuisance does not impair any person’s right to recover damages for the nuisance’s past existence. Removal or termination of the nuisance therefore does not erase a damages claim based on harm already caused while the nuisance existed, preserving retrospective monetary relief after abatement.
