California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 3 — Nuisance, Title 3 — Private Nuisances, Section 3503

Where a private nuisance results from a mere omission of the wrongdoer, and cannot be abated without entering upon his land, reasonable notice must be given to him before entering to abate it.

Notes

Requires reasonable notice to a wrongdoer before a person enters the wrongdoer’s land to abate a private nuisance when the nuisance results merely from the wrongdoer’s omission and cannot be abated without entry. The notice requirement therefore applies specifically to omission-based nuisances that require access to the wrongdoer’s property.
