California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 5 — Common Interest Developments, Chapter 1 — General Provisions, Article 2 — Definitions, Section 4130

“Declarant” means the person or group of persons designated in the declaration as declarant, or if no declarant is designated, the person or group of persons who sign the original declaration or who succeed to special rights, preferences, or privileges designated in the declaration as belonging to the signator of the original declaration.

Notes

Defines declarant as the person or group designated as declarant in the declaration or, if none is designated, the person or group signing the original declaration or succeeding to special rights, preferences, or privileges identified in the declaration as belonging to the original signator. The definition therefore provides both a primary designation rule and fallback routes.
