California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 5 — Common Interest Developments, Chapter 8 — Assessments and Assessment Collection, Article 2 — Assessment Payment and Delinquency, Section 5690

An association that fails to comply with the procedures set forth in this article shall, prior to recording a lien, recommence the required notice process. Any costs associated with recommencing the notice process shall be borne by the association and not by the owner of a separate interest.

Notes

Requires an association that failed to follow the article's procedures to restart the required notice process before recording a lien. The association, rather than the owner of the separate interest, must bear all costs associated with recommencing that notice process, placing the expense of curing the procedural failure on the association.
