California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 6 — Works of Improvement, Title 2 — Private Works of Improvement, Chapter 4 — Mechanics Lien, Article 4 — Property Subject to Lien, Section 8442
The following interests in real property to which a lien attaches are subject to the lien:
(a) The interest of a person that contracted for the work of improvement.
(b) The interest of a person that did not contract for the work of improvement, if work for which the lien is claimed was provided with the knowledge of that person, unless that person gives notice of nonresponsibility under Section 8444.
Notes
Establishes that a lien attaches to the real-property interest of a person who contracted for the work and to a noncontracting person’s interest when the liened work was provided with that person’s knowledge. Exempts the knowledgeable noncontracting person’s interest if that person gives the statutory notice of nonresponsibility.
