California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 6 — Works of Improvement, Title 2 — Private Works of Improvement, Chapter 6 — Payment Bond, Section 8602

Section 8600 does not preclude an owner from requiring a performance bond, payment bond, or other security as protection against a direct contractor’s failure to perform the direct contract or to make full payment for all work provided pursuant to the contract.

Notes

Allows an owner, despite the referenced provision, to require a performance bond, payment bond, or other security protecting against a direct contractor’s failure to perform the direct contract or fully pay for work provided under it. The provision preserves the owner’s ability to require those forms of protection.
