Section 170.6 does not apply to a judge designated or assigned to serve on the appellate division of a superior court in the judge’s capacity as a judge of that division.

Notes

Exempts a judge serving by designation or assignment on a superior court’s appellate division from the peremptory judicial-prejudice procedure in Section 170.6 when acting in that appellate-division capacity. The exclusion applies specifically to the judge’s service as a judge of the appellate division, rather than to every role the judge may perform.
