A trial jury shall consist of 12 persons, except that in civil actions and cases of misdemeanor, it may consist of 12 or any number less than 12, upon which the parties may agree.
Notes
Sets a trial jury at 12 persons, but allows parties in civil actions and misdemeanor cases to agree to a jury of fewer than 12. The provision does not authorize a reduced jury in other cases and states no minimum number below 12 for the civil or misdemeanor exception.
