When any process remains with the sheriff unexecuted, in whole or in part, at the time of his death, resignation of office, or at the expiration of his term of office, such process shall be executed by his successor or successors in office.
Notes
Requires a sheriff’s successor in office to execute any process that remains wholly or partly unexecuted when the prior sheriff dies, resigns, or reaches the end of the term of office. The duty passes to the successor or successors and the provision states no separate deadline, exception, or alternative procedure.
