California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 10.5 — Partition of Real and Personal Property, Chapter 5 — Division of the Property, Section 873.240

Where real property consists of more than one distinct lot or parcel, the property shall be divided by such lots or parcels without other internal division to the extent that it can be done without material injury to the rights of the parties.

Notes

Requires real property consisting of more than one distinct lot or parcel to be divided along those existing lot or parcel lines, without further internal division, to the extent that division can be accomplished without material injury to the parties’ rights. Further internal division is therefore not required where that condition is satisfied.
