California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 13 — Appeals in Civil Actions, Chapter 1 — Appeals in General, Section 913

The dismissal of an appeal shall be with prejudice to the right to file another appeal within the time permitted, unless the dismissal is expressly made without prejudice to another appeal.

Notes

Establishes that dismissal of an appeal is with prejudice to filing another appeal within the otherwise permitted time unless the dismissal expressly states that it is without prejudice to another appeal. The default effect therefore bars another appeal, while an express without-prejudice dismissal preserves the possibility of a later timely appeal.
