California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 14 — Of Miscellaneous Provisions, Chapter 2 — Bonds and Undertakings, Article 14 — Liability of Principal and Sureties, Section 996.420

(a) A surety on a bond given in an action or proceeding submits itself to the jurisdiction of the court in all matters affecting its liability on the bond.

(b) This section does not apply to a bond of a public officer or fiduciary.

Notes

Establishes that a surety on a bond given in an action or proceeding submits to the court’s jurisdiction for all matters affecting liability on that bond. Exempts bonds of public officers and fiduciaries from this jurisdictional rule, leaving those bond types outside the section’s stated court-jurisdiction provision.
