California CodesCode of Civil Procedure - CCPPart 2 — Of Civil ActionsTitle 2 — Of the Time of Commencing Civil ActionsChapter 4 — General Provisions as to the Time of Commencing ActionsSection 354

When a person is, by reason of the existence of a state of war, under a disability to commence an action, the time of the continuance of such disability is not part of the period limited for the commencement of the action whether such cause of action shall have accrued prior to or during the period of such disability.

Notes

Extends the period to commence an action by excluding any time during which a state of war creates a disability preventing the person from filing. The exclusion applies whether the cause of action accrued before or during the wartime disability and lasts for the continuation of that disability, with no additional exception stated.
