If an action is commenced within the time prescribed therefor, and a judgment therein for the plaintiff be reversed on appeal other than on the merits, a new action may be commenced within one year after the reversal.

Notes

Allows a new action to be commenced within one year after reversal when the plaintiff timely commenced the original action and obtained a judgment that was reversed on appeal for a reason other than the merits. The one-year restart is unavailable when the appellate reversal was on the merits.
