California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 3A — Vexatious Litigants, Section 391.4

When security that has been ordered furnished is not furnished as ordered, the litigation shall be dismissed as to the defendant for whose benefit it was ordered furnished.

Notes

Requires dismissal of litigation as to the defendant for whose benefit security was ordered when the ordered security is not furnished. The consequence follows from noncompliance with the security order and applies specifically to the defendant protected by that requirement rather than automatically dismissing the litigation as to every defendant.
