California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 4.5 — Recording Notice of Certain Actions, Chapter 1 — Definitions and General Provisions, Section 405.3

“Probable validity,” with respect to a real property claim, means that it is more likely than not that the claimant will obtain a judgment against the defendant on the claim.

Notes

Defines probable validity of a real-property claim to mean that the claimant is more likely than not to obtain a judgment against the defendant on that claim. The provision supplies this probability standard for the chapter and states no separate evidentiary procedure, numerical burden beyond more-likely-than-not, exception, or remedy.
