California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 7 — Other Provisional Remedies in Civil Actions, Chapter 2 — Claim and Delivery of Personal Property, Article 1 — Words and Phrases Defined, Section 511.090

A claim has “probable validity” where it is more likely than not that the plaintiff will obtain a judgment against the defendant on that claim.

Notes

Defines probable validity of a claim as meaning it is more likely than not that the plaintiff will obtain a judgment against the defendant on that claim. The standard therefore requires a likelihood favoring judgment for the plaintiff, rather than certainty that the plaintiff will ultimately prevail.
