California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 9 — Enforcement of Judgments, Division 1 — Definitions and General Provisions, Chapter 20 — Transitional Provisions, Section 694.090

On and after the operative date, a declaration of homestead made under prior law pursuant to Title 5 (commencing with Section 1237) of Part 4 of Division 2 of the Civil Code is effective only to the extent provided in Article 5 (commencing with Section 704.910) of Chapter 4 of Division 2.

Notes

Limits a declaration of homestead made under prior law, on and after the operative date, to whatever effect is provided by the specified homestead article in the enforcement title. The old declaration does not retain broader effect merely because it was validly made under prior law.
