California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 9 — Enforcement of Judgments, Division 2 — Enforcement of Money Judgments, Chapter 5 — Wage Garnishment, Article 5 — Procedure for Earnings Withholding Orders and Exemption Claims, Section 706.109

An earnings withholding order may not be issued against the earnings of the spouse of the judgment debtor except by court order upon noticed motion.

Notes

Prohibits issuance of an earnings withholding order against the earnings of a judgment debtor's spouse unless a court first authorizes the order. The required authorization must be obtained by court order on a noticed motion, so the spouse's earnings cannot be reached by an ordinary issuance process without that judicial step.
