California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 9 — Enforcement of Judgments, Division 4 — Third-party Claims and Related Procedures, Chapter 4 — Hearing on Third-Party Claim, Section 720.350

(a) Subject to the power of the court to permit an amendment in the interest of justice:

(1) The third-party claim constitutes the pleading of the third person.

(2) In the case of a third-party claim by a secured party, the creditor’s statement constitutes the pleading of the creditor.

(b) A third-party claim of ownership, right to possession, or a lien, shall be deemed controverted by the creditor.

Notes

Establishes the third-party claim as the third person’s pleading and, for a secured-party claim, the creditor’s statement as the creditor’s pleading, subject to the court’s power to allow amendments in the interest of justice. A third-party claim asserting ownership, a right to possession, or a lien is automatically treated as controverted by the creditor.
