California Codes, Code of Civil Procedure - CCP, Part 3 — Of Special Proceedings of a Civil Nature, Title 1 — Of Writs of Review, Mandate, and Prohibition, Chapter 2 — Writ of Mandate, Section 1088.5
In a trial court, if no alternative writ is sought, proof of service of a copy of the petition need not accompany the application for a writ at the time of filing, but proof of service of a copy of the filed petition must be lodged with the court prior to a hearing or any action by the court.
Notes
Allows a trial-court writ applicant who does not seek an alternative writ to file without simultaneously providing proof that a petition copy was served. Proof of service of the filed petition must, however, be lodged before the hearing or before the court takes any action on the application.
