When the violation of a right admits of both a civil and criminal remedy, the right to prosecute the one is not merged in the other.
Notes
Establishes that when a violation of a right permits both a civil remedy and a criminal remedy, the right to prosecute one remedy is not merged into the other. The availability or prosecution of one type therefore does not absorb the separately available right to prosecute the other type.
