California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 1 — Liens in General, Article 3 — Effect of Liens, Section 2889

All contracts for the forfeiture of property subject to a lien, in satisfaction of the obligation secured thereby, and all contracts in restraint of the right of redemption from a lien, are void.

Notes

Prohibits contracts that forfeit property subject to a lien in satisfaction of the secured obligation and contracts that restrain the right to redeem property from a lien. Makes both kinds of agreements void, so neither a lien-based forfeiture agreement nor an agreement restricting lien redemption is enforceable under the provision.
