The failure of a licensee to comply with this article shall be grounds for disciplinary action. A violation of this article shall not be grounds for any criminal action, pursuant to this division, against a licensee or an agent or employee of a licensee.

Notes

Establishes noncompliance with responsible beverage service requirements as grounds for disciplinary action against a licensee. A violation does not, however, provide grounds under the alcoholic-beverage division for criminal action against the licensee or against an agent or employee of the licensee, limiting the provision’s stated consequence to licensing discipline.
