A servitude thereon cannot be held by the owner of the servient tenement.

Notes

Prohibits the owner of a servient tenement from holding a servitude on that same tenement. The rule prevents the owner of the land bearing the servitude from simultaneously holding the servitude thereon, making ownership of the burdened tenement incompatible with holding that particular servitude.
