The extent of a servitude is determined by the terms of the grant, or the nature of the enjoyment by which it was acquired.

Notes

Sets the extent of a servitude according to either the terms of the grant that created it or the nature of the enjoyment through which it was acquired. The scope of the servitude therefore follows its express grant when one controls, or otherwise the character of the qualifying enjoyment.
