California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 1 — Liens in General, Article 3 — Effect of Liens, Section 2892

One who holds property by virtue of a lien thereon, is not entitled to compensation from the owner thereof for any trouble or expense which he incurs respecting it, except to the same extent as a borrower, under Sections 1892 and 1893.

Notes

Limits compensation for a person holding property by virtue of a lien: the holder may not charge the owner for trouble or expense concerning the property beyond the compensation allowed to a borrower under the referenced provisions. The lienholder’s recovery for such trouble or expense is therefore capped at that borrower-equivalent extent.
