California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 19.1 — Mortgage Forbearance Act, Section 3273.29
(a) It is the intent of the Legislature that a mortgage servicer offer a borrower forbearance that is consistent with the mortgage servicer’s contractual or other authority. Nothing in this title requires a mortgage servicer to take any action that would require the mortgage servicer to breach the terms of an existing contract with the investor that owns or insures the residential mortgage loan.
(b) It is the intent that this title not apply to servicing guidelines that are unrelated to disaster-related forbearance relief.
Notes
Establishes legislative intent that a mortgage servicer offer disaster-related forbearance consistent with its contractual or other authority and that the title not apply to servicing guidelines unrelated to disaster forbearance. Limits the title by stating that it does not require a servicer to breach an existing contract with the investor owning or insuring the residential mortgage loan.
