California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 7 — Carriage, Chapter 5 — Common Carriers, Article 1 — Common Carriers in General, Section 2173
A common carrier is entitled to a reasonable compensation and no more, which he may require to be paid in advance. If payment thereof is refused, he may refuse to carry.
Notes
Allows a common carrier to charge reasonable compensation and no more, and to require that compensation in advance. If the customer refuses to pay the reasonable compensation demanded in advance, allows the carrier to refuse carriage, linking the right to decline carriage to refusal of that permitted payment demand.
