California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 7 — Carriage, Chapter 5 — Common Carriers, Article 1 — Common Carriers in General, Section 2174

Section Twenty-one Hundred and Seventy-four. The obligations of a common carrier cannot be limited by general notice on his part, but may be limited by special contract.

Notes

Limits a common carrier’s ability to restrict its obligations: a general notice cannot limit those obligations, but a special contract may. Establishes that the permitted limitation must arise through a special contract rather than through the carrier’s general notice, while leaving the carrier’s obligations otherwise governed by the stated rule.
