When a debtor is entitled to the performance of a condition precedent to, or concurrent with, performance on his part, he may make his offer to depend upon the due performance of such condition.
Notes
Allows a debtor who is entitled to performance of a condition precedent to, or concurrent with, the debtor’s own performance to make the debtor’s offer conditional on due performance of that condition. The tender may therefore depend on the other required condition being properly performed.
